Definitions
- Software = The Software program is "FRED" (Forensics Research Evidence Developer), all included documentation, resources, and any other components.
- Licensee = The Licensee is the end user of the Software. This includes any end user, including but not limited to the original installer of the Software, the individual who registers the Software, and any other individual who may use the Software at any time.
- Licensor = I, Daniel Engel, the author and copyright holder of the Software.
- License = This document, a binding legal agreement between the Licensee and the Licensor.
License Information
The Licensor of this Software grants you, the Licensee of this Software, the right to install and use the Software, provided all terms of this license are complied with. These rights are detailed in this License document.
When the Software is first executed, it will initialize license data on the Licensee's computer. The Licensee will then have thirty days from this first execution to evaluate the Software free of charge. Any time after installing the Software, the Licensee may register the Software by paying the requested registration fee. Upon payment of this fee, and submission of a valid serial number with its accompanying authorization code, the Licensee will be given a license key to the Software. The license key will work on one computer only.
If, at any time, the Licensee wishes to change the computer on which registered Software resides, the Licensee must use the licensing form within the application to reset the Software registration status. By submitting a new serial number with its authorization code, as well as proof that a previous registration has been unregistered the Licensee may obtain credit for one new registration on a second computer without payment of the customary registration fee.
When the Licensee fails to register the Software by the thirtieth day following the first execution of the Software, the Software will no longer run correctly. The Licensee must register the Software before it will be operable again. UPON ANY ATTEMPT TO CIRCUMVENT, INVALIDATE, BYPASS, THWART, OR OTHERWISE DEFEAT SECURITY MEASURES IMPLEMENTED IN THIS SOFTWARE WITH THE INTENT TO OBTAIN UNLICENSED USE AFTER EXPIRATION WITHOUT PAYING THE REQUIRED REGISTRATION FEE, BOTH THIS LICENSE AND THE LICENSEE'S RIGHT TO USE THE SOFTWARE WILL IMMEDIATELY AND AUTOMATICALLY BE TERMINATED.
Restrictions and Privileges
The Licensee is granted no rights except those specified within this document. The Licensee is further specifically prohibited from the following activities: The Licensee may not reverse engineer, decompile, disassemble, or otherwise modify the Software. The Licensee may also not transfer, rent, lease, modify, sublet, sublicense, or otherwise distribute the Software.
Statement of Ownership and Copyright
The Licensee acknowledges that this License is a limited, nonexclusive license. The Licensee also acknowledges that the Licensor is the sole owner of all rights, titles, interests, and other ownership claims in the Software.
Software Warranty:
THE SOFTWARE HAS NO WARRANTY. IF YOU, THE LICENSEE, SEE FIT TO USE THE SOFTWARE FOR A SPECIFIC PURPOSE, YOU DO SO AT YOUR OWN RISK. THE LICENSOR DISCLAIMS ALL EXPRESS AND INPLIED WARRANTIES OF ANY NATURE, INCLUDING WARRANTIES ON TITLE, NONINFRINGEMENT, FITNESS OF THE SOFTWARE FOR A PARTICULAR USE, OR ANY OTHER WARRANTIES.
IN NO CASE SHALL THE LICENSOR BE LIABLE FOR ANY COSTS REGARDING OR RELATING TO THE SOFTWARE, INCLUDING COMPENSATORY, SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OF CONSEQUENTIAL DAMAGES ARISING OR RESULTING FROM THIS LICENSE, THE ACTIONS OF THE LICENSEE, OR THE USE OR INABILITY TO USE THE SOFTWARE. THESE LIMITATIONS APPLY EVEN IN THE EVENT THAT THE LICENSOR HAS BEE NOTIFIED OF THE POSSIBLITY OF SUCH DAMAGES.
Limitation of Damages:
Under all circumstances, the maximum liability of the Licensor and the maximum compensation for the Licensee under this License shall not exceed $1 (US).
Termination:
The licensor has the right to terminate this License and the right of the Licensee to use the Software upon any material breach of this License by the Licensee. This License will terminate automatically if you fail to observe the terms of the License. Upon the expiration or termination of this License, the Licensee is required to destroy or return to the Licensor all copies of the Software, in any form and on any system.
General Terms:
This License is governed by the Law of the State of Oregon.
The Licensee agrees to defend and indemnify the Licensor and to hold the Licensor harmless from all claims, losses, damages, complaints, or expenses connected with of resulting from the Licensee's business operations.
IF YOU, THE LICENSEE, FULLY AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THE PRECEDING CLAUSES, CHECK THE 'I AGREE' BOX BELOW. CHECKING THIS BOX IS LEGALLY EQUIVALENT TO A SIGNATURE BY THE LICENSEE. THIS LICENSE IS ALSO VALID WITHOUT SUCH SIGNATURE. IT WILL BECOME EFFECTIVE AGREEMENT TO THE LICENSE TERMS OR UPON THE LICENSEE'S FIRST USE OF THE SOFTWARE, WHICHEVER COMES FIRST. IF YOU DO NOT FULLY AGREE TO THE TERMS AND CONDITIONS OF THIS LICENSE, PRESS THE BUTTON LABELED 'CANCEL' TO ABORT THE INSTALLATION PROCESS, BECAUSE THE LICENSOR IS UNWILLING TO ALLOW YOU TO USE THE SOFTWARE UNDER TERMS OTHER THAN STATED IN THIS LICENSE.
